1. Agreement to Terms

By accessing and using SplitWit ("Service"), you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily use the Service for personal or commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose without proper licensing
• Attempt to decompile or reverse engineer any software contained in the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Service Description

SplitWit provides conversion rate optimization (CRO) analysis and A/B test documentation services. The Service includes:

• Automated website analysis using AI technology
• A/B test documentation and results tracking
• Team collaboration features
• Screenshot capture and storage
• Statistical calculations and recommendations

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

5. Subscription and Payment

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis. Billing cycles are set on a monthly or annual basis.

At the end of each billing cycle, your subscription will automatically renew unless you cancel it or we cancel it. You may cancel your subscription renewal through your account settings.

6. Data Usage and Storage

By using the Service, you grant us permission to:

• Capture screenshots of publicly accessible websites you submit for analysis
• Store your experiment data, analysis results, and related content
• Process your data using third-party AI services (Claude API)
• Use aggregated, anonymized data to improve our services

7. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of SplitWit and its licensors.

8. User-Generated Content

You retain all rights to the content you submit, post or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, publish, transmit, and display such content.

9. Prohibited Uses

You may not use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• To interfere with or circumvent the security features of the Service

10. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

We do not guarantee that the Service will be available at all times or that it will be error-free. Analysis results and recommendations provided by the Service are suggestions only and should not be considered professional advice.

11. Limitation of Liability

In no event shall SplitWit, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
